Terms & Conditions

We want to make your stay in a Holiday Rentals Australia property as enjoyable as possible and we assure you that we will be working hard to do this. However, you will understand that to allow us to do this and also to maintain the standards of the properties for you and for future guests, we have to have some rules. Ours are based upon accepted industry practice and normal careful use of the property.


By paying the deposit you, the guest, have offered to rent the property described on our website and in the booking confirmation email from us, Holiday Rentals Australia, acting as agent for the owner of the property, upon these terms and conditions. You also agree to be bound by these terms and conditions.


The property is described in the Holiday Rentals Australia website (www.HolidayRentalsAustralia.com.au) and the booking confirmation email. Please check the website and the booking confirmation email carefully. While every effort has been made to describe the property accurately, we do not accept responsibility for any differences between the description and the actual property but please rest assured we have made every effort to be as accurate as possible.

Similarly, we are not responsible if the accommodation that you choose does not meet your chosen style. To reduce the risk of this happening, please study the description of the property on the Holiday Rentals Australia website, and/or ask us for any specific details that are important to you before you book.

All properties are different and some have special instructions to allow you to operate the utilities and services, or for safety. These are in the manual provided in the property, and you agree to follow these instructions.

We will not be responsible for the failure of utilities, essential services or appliances. We will take all reasonable steps to have the problem fixed if you tell us, but immediate repair may not be possible. We will not give you a discount on the rental if we cannot arrange a repair during your stay.


When we accept your offer to rent the property and receive your deposit, we will reserve the property for your exclusive use during the rental period. By paying the deposit, you agree to pay the balance of the rental fees by the due date specified in the booking confirmation email. If you do not do so we will be entitled to assume that you have cancelled this agreement and forfeited all monies paid.

Payment by debit/credit card and direct deposit is welcome. A card transaction fee of 2-3% applies to card payments. When your booking is being confirmed and payment being request you’ll be advised of the charges depending on how you wish to pay.

If you chose to pay by credit card then you authorise us to complete any documentation for the purpose of a credit card system, and to amend and complete any credit card documentation for any charges including loss, damage or excess cleaning that you owe us under the terms of this agreement.


As part of your booking you must provide Holiday Rental Australia with payment of a security deposit before the start of your rental. The value of deposit for each property is shown in the listing for that property and in your booking cost breakdown. If the total of any damage or losses arising during your stay is greater than the security deposit you agree to pay the balance on demand from us. We have the right to retain the security bond until any potential or outstanding claims relating to your use of the property are resolved. Please note that we reserve the right to increase the security bond for any groups which, we believe, fall into a higher risk category.


We will make the property available for your use and in a clean and tidy condition at the start time and date shown in the booking confirmation email. However, we may at any time cancel your booking if in our sole discretion there are reasons which require us to do so (please be advised this has been exceptionally rare and is ordinarily due to circumstances beyond our control such as major property damage or pandemic). If this happens we will give you a full refund of all monies that you have paid and we will have no further liability to you.

We endeavour to meet all guests on arrival at the property and a guest registration from will be completed at the time. We expect all guests to be able to advise us of a specific arrival time and keep to that time. Advance notice will need to be given if this timing needs to change and we cannot guarantee that will be able to meet you at your revised time if it is changed at short notice due to pre-agreed other guest arrivals. We do make every possible effort to be flexible however but we do expect some assistance from guests with regard to arriving on time.


You must vacate the property by the finish time and return the keys to us as directed in the Welcome Letter found inside the property. You agree that if you fail to do so you may cause us to incur extra costs. If you vacate later than this finish time you will pay us a late return fee of a minimum of an extra day’s rate, together with any costs or loss of profits and damages that we may incur as a result of the delay.

You agree to leave the property neat and tidy with everything being put back (clean) where you found it. If you fail to do this, we may impose an additional cleaning charge. We do not expect you to wash your bedding and towels but all kitchen items that have been used must be cleaned and put away along with any dishwasher being emptied. You may not remove anything from the property that was there on your arrival. We have an inventory of all contents of the property.

When you leave, you will follow all special instructions in the Welcome Letter in the property. This should include standard common sense practices of making sure all heating and cooling, appliances, burners and lights are switched off and windows and doors closed and locked.

We will inspect the property after your rental finishes. You agree that you will pay for any damage to the property beyond normal wear and tear, or any losses, or excess cleaning required as a result of your use. You will also pay our costs in arranging for these.


You agree that you will not have more guests stay in the property at any time during your rental period than the maximum capacity specified for the property. This includes the grounds of the property.


The supervision of children in relation to any risks of dangers at the property remains the sole responsibility of guests at all times. We take no responsibility for any aspects of the property that may not be deemed child sage.


You must not bring pets onto the property at any time.


You agree that you will not allow smoking inside the property at any time. You will also face a potential claim for damages.


You also agree that you:
Will not part with possession of the property or assign this agreement.
Will only use the property for the purposes of holiday accommodation and for no other purpose. Will be responsible for the property at all times during your rental including the times that you leave the property unoccupied. Please note that the insurance requires that all doors and windows be locked whenever you leave the property. Will tell us immediately if you do any damage, or if any part of the property needs repair. Will not attempt repairs and shall be responsible for the consequences of unauthorised repairs. Will not take firearms onto the property.


The property is covered by risk insurance which covers fire, storm and tempest damage, third party damage and public risk. You agree that you will not commit any act which would invalidate the Insurance Policy.


You agree that we have the right at all times to bring this agreement to an end and repossess the property without refund to you if:
the property is incorrectly used so as to endanger the property and its occupants or any other property or life;
you or any member of your party behaves in a manner which is likely to prejudicially affect our or the owners interest in the property or the goodwill of our business. This includes excessive noise or disturbance, or having more people on the property than the house allows.


You agree to indemnify and hold us harmless against any loss or damage which arises out of the use of the property by you that is in breach of these terms and conditions or through negligence by you or any member of your party.

You understand that you will be liable for all consequential loss in addition to the usual remedies available at law including loss of income where the property is put out of operation and cannot be used for subsequent rental periods as a result of the breach of these terms and conditions by you, or as a result of negligence by you or any member of your party.

You and the members of your party use the property at your own risk and neither we nor the property owner accept any responsibility for accidents, injuries or death due to use of equipment whether provided by us, the property owner or by you. We are also not responsible to any person for loss or damage to any property, personal belongings or personal affects stolen from the property or damaged or otherwise lost during your rental period.


Cancellation Policy

We understand that circumstances may arise where you need to cancel your reservation. Should this occur, all booking cancellations must be notified in writing to Holiday Rentals Australia, and the following cancellation fees will apply:
Cancellations made between 0 and 14 days of the arrival date, no refund is applicable, unless the property is rebooked, in this instance a partial refund may be available.
Cancellations made more than 14 days prior to the arrival date will receive a full refund less any card transaction charges.
